This is one of the least talked about — and most important — parts of the process. Because the same decision can have completely different outcomes depending on where you live.

Parental recognition

In some countries, both parents in a same-sex couple are automatically recognized. In others, only the biological parent is.

Which means the second parent may need to go through:

Even if they were involved from the beginning.

Donor-related laws

If you’re using a donor, legal rights vary widely. In some places donors have no parental rights. In others things are less clearly defined. This becomes especially important with known donors.

Surrogacy laws

This is where things get even more complex. Some countries fully allow surrogacy. Some restrict it. Some ban it entirely. And LGBTQ+ access isn’t always equal.
