Welcome to LetsBeParents. These Terms of Use (“Terms”) constitute a legally binding agreement between you (the “User”) and BYITSMART DOO, the developer and operator of the LetsBeParents mobile application, website, and related services (collectively, the “Service”).

By accessing or using our Service, you agree to comply with and be bound by these Terms. If you do not agree, you may not access or use the Service.

1. Eligibility

  • You must be at least 18 years old to use the Service.
  • By creating an account, you affirm that you have the legal capacity to enter into this agreement.

2. Account Registration

  • Users must provide accurate and complete information.
  • You are responsible for safeguarding your login credentials.
  • You are solely responsible for any activity conducted under your account.

3. Service Scope, Medical Disclaimer & Data Sharing

LetsBeParents is a platform designed to enable individuals to connect for the purposes of co-parenting, donation, and surrogacy-related conversations.

We do not provide medical services, legal services, or directly facilitate the provision, donation, or sale of gametes or surrogacy services.

Any information shared through health-related questionnaires, personality forms, or user profiles is intended solely for communication and matching purposes. It does not substitute for professional medical advice, diagnosis, or screening.

Users may voluntarily share information related to reproductive health, fertility, parenting preferences, and related medical context. By using the Service, you expressly consent to the collection, processing, and use of such data. This information is used solely to facilitate relevant connections and improve your experience.

We strongly recommend that all users:

  • Verify the identity of potential partners independently;
  • Undertake appropriate medical screening and STI testing before any arrangement;
  • Consult with a legal professional about parental rights, responsibilities, and the enforceability of private agreements;
  • Seek guidance from a licensed fertility clinic where applicable, as clinics offer regulated environments, identity verification, and post-birth registration.

We also use trusted third-party services such as Firebase, Twilio Segment, and other analytics/payment providers. These services may access non-identifiable or pseudonymous data to enable key functionality, personalization, performance monitoring, and fraud prevention.

By using the app, you consent to your data being shared with such providers under secure and lawful conditions.

Grounds for Profile Removal Based on Health Conditions
To ensure the safety and well-being of all users, profiles may be removed if the user discloses or is found to have any of the following disqualifying health conditions. This list is based on standard fertility clinic guidelines and is not exhaustive:

  • Infectious Diseases (STIs/STDs): HIV/AIDS, Hepatitis B/C, Chlamydia, Gonorrhea, Syphilis, Herpes simplex virus type 2 (HSV-2) and HPV strains with E6/E7 proteins, Chlamydia, Gonorrhea, or any untreated STI within the last 12 months.
  • Genetic Disorders: Cystic Fibrosis (CF), Huntington’s Disease, Fragile X Syndrome, Thalassemia, Sickle Cell Anemia, Tay-Sachs Disease, or any hereditary condition that could be passed to offspring.
  • Reproductive Health Issues: Polycystic Ovary Syndrome (PCOS) (uncontrolled), Endometriosis, Irregular menstrual cycles (for egg donors), Low sperm count/motility (for sperm donors), or history of infertility treatments.
  • Chronic or Serious Medical Conditions: Cancer (history within 5 years), Heart disease, Autoimmune disorders (e.g., Lupus, Rheumatoid Arthritis), Thyroid disorders (uncontrolled), Diabetes (Type 1/2), Epilepsy, or Mental health conditions requiring ongoing medication (e.g., Bipolar, Schizophrenia).

Users must disclose all relevant health information. Failure to do so may result in immediate profile removal without refund. This is for informational purposes only and not medical advice.

4. Freemium Model & Paid Features

  • The Service operates under a freemium model: basic access is free.
  • Premium features (e.g., initiating contact with certain users such as donors, surrogates, or co-parents) require a paid subscription.
  • Subscription terms:
    • Subscriptions are billed via Apple App Store or Google Play.
    • Prices and billing terms are disclosed within the app prior to purchase.
    • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the billing period.
    • Refunds are handled according to the policies of the app store where the subscription was purchased.

5. User Conduct, Community Standards & System Security

You agree NOT to:

  • Harass, deceive, coerce, or manipulate other users.
  • Create fake profiles or misrepresent your identity (“catfishing”).
  • Use VPNs or proxy services to mask your location.
  • Share explicit content, nudity, or sexual messages.
  • Promote commercial services, solicitations, or payments for reproductive material or services.
  • Violate applicable laws, including those governing donation, surrogacy, and parentage.

LetsBeParents reserves the right to suspend or terminate accounts for violating these standards.

6. System Security and Technical Misuse

You agree not to:

  • Send bulk or unsolicited communications, including spam, commercial solicitations, or chain letters, through the Service;
  • Infringe upon the copyright, trademark, or other intellectual property rights of any party;
  • Post or transmit any unlawful, abusive, defamatory, obscene, hateful, or otherwise objectionable content;
  • Exploit minors or post content that invades the privacy of others;
  • Continue contacting users who have requested no further communication;
  • Engage in deceptive marketing or fraudulent activity;
  • Impersonate another person or misrepresent your affiliation.

Violation of these policies may result in immediate suspension or permanent removal from the platform.

7. Enforcement & Cooperation with Authorities

We take platform abuse, spam, fraud, and technical attacks extremely seriously. Users found engaging in any such activities — including unauthorized scraping, impersonation, unsolicited messaging, phishing, or malicious code distribution — will face immediate account termination without notice.

We reserve the right to:

  • Report abuse, harassment, or illegal conduct to law enforcement authorities;
  • Disclose relevant account, device, and activity data in response to lawful requests;
  • Assist investigations by providing logs, communications, IP information, and account history.

If you attempt to disrupt our platform, exploit our users, or degrade the experience of others — we will respond swiftly, decisively, and without apology.

8. Third-Party Services & Data Sharing

  • We utilize services such as Firebase, Twilio Segment, and other analytics/payment processors.
  • These providers may access non-identifiable or pseudonymous data necessary for functionality, analytics, personalization, and fraud prevention.
  • By using the app, you consent to data being shared with these providers under secure and lawful terms.

9. Privacy

  • Please refer to our separate Privacy Policy for a full overview of what data we collect and how it is used.

10. Termination

  • We reserve the right to suspend or terminate your access at any time if you violate these Terms.
  • Termination does not relieve you of obligations to pay outstanding subscription fees, if any.

11. Disclaimer of Warranties

  • The Service is provided “as is” without warranties of any kind.
  • We do not guarantee matches, medical accuracy, or successful reproductive outcomes.
  • LetsBeParents is not a clinic, agency, or licensed reproductive intermediary.

12. Limitation of Liability

To the maximum extent permitted by law:

  • BYITSMART DOO shall not be liable for indirect, incidental, consequential, or punitive damages.
  • Total liability shall not exceed the amount paid by you for the Service in the past 12 months.

13. Governing Law & Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
  • Any disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association.
  • You waive any right to participate in class actions.

14. Modifications to Terms

  • We may revise these Terms at any time. Material changes will be communicated via the app.
  • Continued use of the Service after updates constitutes acceptance of the revised Terms.
